VibeMyCar Terms of Service

1. Acceptance of Terms

Welcome to VibeMyCar. By accessing or using our mobile application and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions of this agreement, you may not access or use our services.

2. Service Description

VibeMyCar is a ride-sharing platform that connects riders with drivers. We do not provide transportation services; we merely connect users and facilitate payments between them. VibeMyCar is not a transportation carrier, nor is it a taxi service.

3. Eligibility

You must be at least 18 years of age to use our Service. By using VibeMyCar, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of the terms and conditions of this agreement.

For Drivers: You must possess a valid driver's license, have appropriate vehicle insurance, own or have permission to use the vehicle you drive, and meet all other eligibility requirements established by VibeMyCar.

4. User Accounts

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your mobile device. You agree to accept responsibility for all activities that occur under your account.

5. User Conduct

You agree not to use the Service for any illegal or unauthorized purpose. You agree to comply with all local laws regarding online conduct and acceptable content.

Prohibited activities include but are not limited to:

• Harassing, threatening, or discriminating against other users
• Submitting false or misleading information
• Impersonating another person or entity
• Using the Service for any illegal activities
• Interfering with or disrupting the Service
• Attempting to gain unauthorized access to the Service or user accounts

6. Ride and Payment Terms

Ride Booking and Cancellations:

• Riders may be charged a cancellation fee for canceling a ride after a driver has been assigned.
• Drivers who repeatedly cancel rides or fail to show up may face penalties or account suspension.
• VibeMyCar reserves the right to adjust pricing during high demand periods.

Payments:

• All payments are processed through our third-party payment processors (PayU and RazorPay).
• VibeMyCar charges a service fee on each transaction.
• Drivers receive payment after the completion of a ride, less applicable service fees.
• We follow a strict no-refund policy as detailed in our Privacy Policy.

7. Driver Obligations

As a driver using VibeMyCar, you agree to:

• Maintain a valid driver's license and vehicle registration.
• Maintain adequate insurance coverage for your vehicle.
• Keep your vehicle in good operating condition.
• Follow all traffic laws and regulations.
• Maintain a professional demeanor with riders.
• Not discriminate against riders based on race, religion, nationality, disability, sexual orientation, gender, or any other protected classification.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIVIBE, VIBEMYCAR, AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, exemplary, punitive, or consequential damages.
• Personal injury or property damage resulting from your use of the Service.
• Any communication, interaction, or dispute between users.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the Service.
• Any bugs, viruses, or the like that may be transmitted to or through the Service.

You agree to defend, indemnify, and hold harmless AiVibe, VibeMyCar, and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service.

9. Termination

VibeMyCar reserves the right to suspend or terminate your account and refuse any and all current or future use of the Service, without warning or notice, for any violation of these Terms or for any other reason at our sole discretion.

10. Account Deletion

You may request account deletion through our Support page. Upon validation:

• Your account data will be permanently deleted within 90 days.
• Deletion may be delayed if there are outstanding legal matters.
• Once deleted, your profile cannot be recovered after 90 days.

11. Force Majeure

VibeMyCar shall not be liable for any failure to perform its obligations where such failure is a result of events beyond its reasonable control, including acts of God, war, riot, natural disaster, labor dispute, or government action.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.

You agree to submit to the personal jurisdiction of the courts located in Chennai for the purpose of litigating all such claims.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
