All payment processing, data security, financial fraud protection, identity verification, anti-money laundering compliance, and transaction monitoring are under the complete and exclusive control and responsibility of the respective payment gateway service providers. We do not store, record, cache, backup, or maintain any financial data, credit card information, bank account details, payment credentials, transaction histories, or any payment-related information on our systems, servers, databases, or any infrastructure under our control.
User Risk Acknowledgment: Users explicitly acknowledge and accept full responsibility and assume complete risk for any unauthorized access, hacking incidents, data breaches, identity theft, financial fraud, phishing attacks, malware infections, or security vulnerabilities occurring on these third-party payment platforms. This includes but is not limited to losses due to compromised accounts, stolen credentials, unauthorized transactions, failed payments, processing delays, currency conversion issues, international transaction fees, or any technical failures within payment gateway systems.
Regional Payment Gateway Compliance: For different geographical regions, we utilize region-specific payment gateways to ensure local compliance and optimal user experience. This includes but is not limited to Alipay and WeChat Pay for China (policies: https://global.alipay.com/privacy), iDEAL for Netherlands, SEPA for Europe, UPI and local banks for India, and other regional providers. Each regional gateway operates under local financial regulations and data protection laws, and users are subject to the specific terms and conditions of these regional services.
Comprehensive Auto-Payment Consent and Communication Authorization: By enabling auto-payment features for any of our services, you provide explicit, informed, and irrevocable consent for payment gateway providers to save, store, and process your payment credentials including but not limited to credit card details, bank account information, digital wallet credentials, and biometric payment data. You hereby authorize AiVibe Software Services Private Limited and all associated payment gateways to send unlimited SMS messages, email notifications, phone calls, push notifications, in-app messages, postal mail, and any other forms of communication regarding payment reminders, failed payment notifications, account updates, promotional offers, service announcements, and billing information to all contact details provided by you, regardless of your Do Not Disturb (DND) preferences, telecom operator restrictions, or communication preferences settings.
Payment Credential Storage and Auto-Debit Authorization: Payment gateways are explicitly authorized to retain, store, and process your credit card details, bank account information, CVV numbers, expiry dates, billing addresses, and any other payment-related data for processing auto-debits, recurring payments, subscription renewals, and any future transactions as per their respective data retention policies and security frameworks. This authorization extends to sharing this information with partner banks, financial institutions, fraud prevention services, and regulatory authorities as required by law or deemed necessary by the payment providers.
Gateway-Specific Support and Liability: For any payment-related issues, disputes, refund requests, chargeback procedures, fraud reports, or technical problems, users must contact the respective payment gateway support teams directly. We do not mediate, intervene in, or take responsibility for any payment gateway-related matters. Each gateway maintains independent customer support, dispute resolution mechanisms, and liability frameworks that operate separately from our services.

Users acknowledge that their data may be processed, stored, analyzed, and shared by these third-party providers according to their respective policies and legal requirements. Any data shared with these services is governed by their privacy frameworks, security measures, and local jurisdictional laws, which may differ from our policies and may change without our knowledge or control.

8. Intellectual Property, Master Service Agreements, and Customer IP
AiVibe Software Services Private Limited owns all brands, trademarks, logos, and intellectual property rights related to our products and services including but not limited to AiVedha, Vibe My Car, Vibe Karo, Vibe Buddy, AiCippy, and AIMURUGA.
No individual or entity is permitted to copy, replicate, imitate, or use any of our brand names, logos, services, or intellectual property without explicit written authorization from AiVibe Software Services Private Limited. Violation of these rights may result in legal action.
Master Service Agreements and Customer IP: For any projects undertaken through master service agreements or supplier contracts, we do not provide support for customer intellectual property protection. All intellectual property created, developed, or enhanced during our engagement remains the ownership of AiVibe Software Services Private Limited, headquartered at A501, Saraduez Olympus, Perumbakkam, Chennai 600100, Tamil Nadu, India. We do not abide by any Non-Disclosure Agreements (NDAs) or confidentiality clauses that are not part of our standard policy, even if signed by our employees. The company operates independently and is not committed to any legal bonds or agreements that contradict our established policies. For executive oversight of such matters, senior management including aravind@aivibe.in and jayagiri@aivibe.in maintain direct responsibility for policy enforcement.
Employee Actions Disclaimer: AiVibe Software Services Private Limited management and investors are not responsible for any fraudulent activities, legal issues, or violations committed by individual employees. Each employee acts in their individual capacity, and any misconduct does not reflect company liability.
9. Comprehensive Warranty and Liability Disclaimer
AiVibe Software Services Private Limited does not provide any product warranty, service guarantee, performance assurance, uptime commitments, data integrity assurance, security guarantees, or any form of warranty commitments for any of our products or services across any platform including but not limited to web applications, mobile applications (iOS App Store, Google Play Store, third-party Android stores), desktop applications (Windows Store, Mac App Store, Linux distributions), smart TV applications (Samsung Smart TV Store, LG Content Store, Android TV, Apple TV, Roku, Amazon Fire TV), smartwatch applications (WearOS, Apple Watch, Samsung Galaxy Watch, Fitbit), gaming console platforms (PlayStation Store, Xbox Store, Nintendo eShop, Steam), automotive platforms (Android Auto, Apple CarPlay, Tesla App Store), enterprise platforms, IoT device interfaces, or any other current or future digital distribution platforms and hardware ecosystems.
Complete Liability Disclaimer: We explicitly disclaim all responsibility and liability for any issues, problems, damages, losses, data breaches, privacy violations, hacking incidents, malware infections, ransomware attacks, identity theft, financial losses, business interruptions, service outages, data corruption, unauthorized access, fraudulent activities, security vulnerabilities, compliance failures, legal violations, or any other adverse events arising from the use of our products or services. This includes but is not limited to issues caused by third-party integrations, platform vulnerabilities, network failures, cyber attacks, human error, natural disasters, or force majeure events.
User Risk Acknowledgment: All services and products are provided strictly "as is" and "as available" without any express, implied, statutory, or common law warranties including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, data accuracy, system compatibility, or uninterrupted service. Users explicitly acknowledge and assume full responsibility and complete risk for ensuring the security, integrity, backup, and protection of their accounts, data, business operations, and digital assets across all platforms and services.
Absolute No Refund Policy: All sales, purchases, subscriptions, service fees, and payments are final and non-refundable under any circumstances. AiVibe operates under an absolute, strict, and irrevocable no-refund policy applicable globally and in full compliance with all international, federal, state, provincial, and local country laws, regulations, and consumer protection statutes. Once payment has been processed, authorized, charged, or collected for any service, product, subscription, feature, add-on, or digital content, absolutely no refunds, chargebacks, reversals, credits, compensation, partial refunds, pro-rata calculations, or any form of monetary return will be provided under any circumstances whatsoever, including but not limited to same-day requests, technical issues, service dissatisfaction, change of mind, duplicate purchases, unauthorized access, fraudulent transactions, service discontinuation, feature changes, price modifications, or force majeure events.
Service Cancellation Policy: Even if services are canceled, discontinued, suspended, terminated, or modified by either party, no pro-rata calculations, partial refunds, service credits, or any form of compensation will be provided. Once payment is processed, users must wait and utilize the service for the entire paid period regardless of usage patterns, satisfaction levels, or changing requirements. This policy applies to all subscription models, one-time payments, recurring charges, auto-renewals, gift purchases, promotional offers, and enterprise agreements.
Limited Exception Clause: Refunds are only available if explicitly mentioned as a specific condition for particular services in writing, with clear terms and conditions, and only under those exact predetermined conditions as specified in individual service agreements. No verbal promises, implied understandings, or general expectations constitute grounds for refund eligibility.
Platform-Specific Risk Disclaimer: Users acknowledge that each digital platform (app stores, smart TV platforms, gaming consoles, automotive systems, IoT devices) has inherent security risks, update mechanisms, compatibility issues, and policy changes that may affect service functionality. We are not responsible for platform-specific problems, forced updates, policy violations, account suspensions, or service discontinuations imposed by third-party platform operators.
10. International Compliance and Legal Jurisdiction
As a comprehensive global service provider operating across USA, Europe (including EU, UK, EEA), Canada, Philippines, Africa, Asia-Pacific, Middle East, Latin America, and other international markets, we comply with all applicable local, federal, state, provincial, regional, and international laws, regulations, standards, and frameworks including but not limited to GDPR (General Data Protection Regulation), CCPA (California Consumer Privacy Act), CPRA (California Privacy Rights Act), PIPEDA (Personal Information Protection and Electronic Documents Act), Data Privacy Act of 2012 (Philippines), POPI Act (South Africa), LGPD (Brazil), Privacy Act 1988 (Australia), Privacy Act 2020 (New Zealand), PDPA (Singapore, Thailand, Malaysia), IT Act 2000 (India), Cybersecurity Law (China), Digital Personal Data Protection Act 2023 (India), and other relevant data protection, cybersecurity, consumer protection, and privacy regulations in all jurisdictions where we operate.
Data Transfer Safeguards: All international data transfers are conducted with appropriate legal safeguards including:

Exclusive Legal Jurisdiction: Regardless of where users access our services, where data is processed, or where legal disputes arise, all legal matters, disputes, litigation, arbitration proceedings, intellectual property claims, contract disputes, data protection violations, consumer complaints, regulatory investigations, and any other legal proceedings related to our services, products, or business operations shall be subject exclusively to the jurisdiction of the High Court of Chennai, Tamil Nadu, India. No other court, tribunal, arbitration panel, or legal jurisdiction will be recognized, accepted, or entertained for any legal proceedings involving AiVibe Software Services Private Limited or any of its subsidiaries, affiliates, products, or services.
Comprehensive Global Compliance and Law Enforcement Cooperation: We strictly comply with international laws and provide full cooperation to law enforcement agencies, regulatory bodies, and judicial authorities regarding child labor prevention, child abuse prevention, Protection of Children from Sexual Offences (POCSO) Act compliance, anti-terrorism laws and regulations, anti-hacking and cybersecurity regulations, women's safety and harassment prevention laws, human trafficking prevention, money laundering prevention (AML), counter-terrorism financing (CTF), sanctions compliance (OFAC, UN, EU), export control regulations (ITAR, EAR), and all other applicable criminal, civil, and regulatory laws.
